Terms of Service

By creating an account or using Marktplace (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using Marktplace on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree to these Terms, you may not use the Service.

Marktplace is a storefront hosting platform for Facebook Marketplace sellers. It allows you to:

• Create a public, branded storefront page at a unique URL (/store/your-slug)
• Manually list products with photos, descriptions, prices, and categories
• Let buyers browse and search your listings in one place
• Route buyer inquiries to your Facebook Messenger via a pre-written message prompt

Marktplace does not process payments, manage orders, or integrate with Facebook's API. All transactions happen outside of Marktplace, directly between sellers and buyers via Facebook Messenger.

You must be at least 18 years old to use Marktplace. By using the Service, you represent that you meet this requirement. The Service is intended for individual sellers and small businesses operating within Facebook's community standards.

You sign in to Marktplace using your Google account via OAuth. You are responsible for:

• Keeping your Google account secure
• All activity that occurs under your Marktplace account
• Ensuring your store information (name, Facebook Page username) is accurate and up to date
• Notifying us immediately at support@marktplace.app if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or have been inactive for an extended period with prior notice where practical.

You agree to use Marktplace only for lawful purposes. You may not list, promote, or facilitate the sale of:

• Illegal goods, controlled substances, or items prohibited in your jurisdiction
• Counterfeit, stolen, or fraudulently obtained items
• Weapons, firearms, or related accessories where prohibited by law
• Items that infringe third-party intellectual property, trademark, or copyright rights
• Adult content or services of any kind
• Items you do not own or have no legal right to sell

You also agree not to: use automated bots or scrapers on the platform; attempt to access another seller's account or data; use Marktplace to send spam or unsolicited messages to buyers; or attempt to reverse-engineer, decompile, or disrupt the Service.

You are solely responsible for the accuracy, legality, and completeness of your product listings. By publishing a listing, you represent that:

• You own or have the right to sell the item
• The description, price, and photos accurately represent the product
• The listing does not violate any applicable law or third-party right

We do not verify individual listings and are not responsible for the quality, safety, legality, or availability of any item listed on your storefront. Any transaction completed with a buyer is solely between you and that buyer.

You retain full ownership of all content you upload to Marktplace, including product photos, descriptions, and store branding. By uploading content, you grant Marktplace a non-exclusive, worldwide, royalty-free license to store, display, and deliver that content solely for the purpose of operating your public storefront.

We will not use your content for advertising or share it with third parties beyond what is necessary to operate the platform (for example, serving images via Cloudflare R2 to buyers visiting your storefront).

Marktplace generates m.me/ links based on the Facebook Page username you provide in your settings. You are responsible for:

• Providing a valid and accurate Facebook Page username
• Managing all buyer communications that occur in Messenger
• Complying with Meta's Terms of Service in your Messenger interactions

Marktplace has no affiliation with Meta Platforms, Inc. “Facebook” and “Messenger” are trademarks of Meta Platforms, Inc. We make no representations about Messenger's availability or reliability.

We aim to keep Marktplace available at all times but do not guarantee uninterrupted access. We may perform maintenance, roll out updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.

We reserve the right to modify, suspend, or discontinue the Service or any feature at any time, with or without notice. We are not liable for any interruption to your storefront access.

You may delete your account at any time from your dashboard settings. This will remove your storefront and all associated data within 30 days.

We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent or harmful activity, or used the Service in a way that could harm other users or Marktplace. Where practical, we will notify you before taking action.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. Marktplace does not warrant that:

• The Service will be error-free, uninterrupted, or completely secure
• Any buyer inquiries generated through your storefront will result in sales
• The Service will meet your specific business requirements

To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Marktplace and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service, including lost profits, lost data, or reputational harm.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the greater of (a) $50 CAD or (b) the total amount you paid to us in the 12 months preceding the claim.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where practical, notify you via email or an in-app notice. Your continued use of Marktplace after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-law provisions. Any disputes arising from these Terms shall be resolved exclusively in the courts of Ontario, Canada.
